New Delhi: Woman takes U-turn, tells court not raped by BJP MLA and others

New Delhi: A woman, who had charged a BJP MLA from Haryana and two others with allegedly raping her, on Thursday took a U-turn in a Delhi court saying she was not raped by them and she does not want any action against the accused.

The woman, while deposing before Additional Sessions Judge Nivedita Anil Sharma in an in-camera proceeding, said there was a financial dispute between her and her friend Rekha Suri, also an accused, and she has got her money back.

The woman, in her complaint earlier, had alleged that she was raped by BJP MLA Umesh Aggarwal and his friend Sandeep Luthra at a Faridabad hotel and Rekha had abetted the crime.

The court also granted bail to Aggarwal and the other two accused on furnishing of a personal bond of Rs 25,000 each and a surety of like amount. It directed them not to tamper with evidence or influence any witnesses.

Advocate Vaibhav Sharma, appearing for the BJP legislator, sought bail for his client saying he has not done anything wrong and was falsely implicated in the case.

The counsel argued that the MLA has fully cooperated with the probe agency and not tampered with any evidence.

According to court sources, the woman today said Rekha had borrowed Rs 50,000 from her last year and was not returning it. So she went with her to a hotel in Faridabad on January 3 where she was supposed get back the money. They said Rekha introduced the woman to Aggarwal who gave Rs one lakh to Rekha which she refused to hand over to the victim at the hotel.

Sources said during their quarrel over money, Aggarwal allegedly passed some comments which offended her. The next day she got an anonymous call after which she got scared and lodged a complaint at Hari Nagar Police Station, the sources quoted the victim as saying.

The prosecutor and DCW counsel Shubhra Mendiratta told the court that the woman was turning hostile and is likely to be cross-examined later by the prosecutor.

The court had earlier framed charges against Aggarwal and Luthra for alleged offences of rape, causing hurt by means of poison and criminal intimidation under provisions of the IPC. It had also framed charges against Rekha for alleged offences of abetment to rape. All the accused have denied the charges and pleading not guilty and claimed trial.

The court had earlier said "it is prima facie clear from the record that accused Rekha abetted and facilitated the commission of offences of intoxication and rape against the prosecutrix by bringing her to (the) Hotel in Faridabad... where accused Umesh Aggarwal administered intoxicated cold drink to the woman and committed rape upon her.

"Then she was raped by accused Sandeep Luthra and they also threatened the prosecutrix not to disclose the incident to anyone," it had said.

"It is prima facie clear that both accused Sandeep Luthra and Umesh Aggarwal have intoxicated, raped and threatened the prosecutrix and accused Rekha has abetted the commission of intoxication and rape by accused Umesh Aggarwal and Sandeep Luthra," the court had said.

As per the police, the woman had alleged that on January 5, at the insistence of Rekha, both of them had gone to a hotel in Faridabad on January 3 where the incident allegedly occured.
