SC puts stay on Rahul Gandhi's disqualification; Congress welcomes the verdict

In a relief to Congress leader Rahul Gandhi, the Supreme Court in an interim order on August 04 stayed his conviction in the criminal defamation case over the ‘Modi surname’ remark. The Gujarat HC had in its order declined to stay his conviction in the criminal defamation case in which Rahul Gandhi was sentenced to two years in jail by the Surat court over the 'Modi surname' remark. After his conviction in the case, Gandhi was disqualified as MP from Kerala’s Wayanad on March 24. Earlier in March, a magisterial court convicted Rahul Gandhi for his ‘Modi’ surname remark ahead of the 2019 general polls.Various Congress leaders invited the Supreme Court’s decision and said that the conspiracy against him had failed and that his victory will come heavily on Prime Minister Narendra Modi.

In a big relief to Rahul Gandhi in the modi-surname defamation case, SC has stayed the conviction of Congress leader Rahul Gandhi. While granting relief to Rahul Gandhi, Supreme Court said that the ramifications of the trial court’s order are wide. However, SC said, Rahul Gandhi’s utterances are not in good taste and is expected to exercise caution while making public speeches. Earlier, Surat Court convicted the Congress leader in a defamation case for his ‘Modi surname’ remark. Surat District Court sentenced Rahul Gandhi to two years of imprisonment in a criminal defamation case.

In a major setback to Rahul Gandhi, the Gujarat high court on Friday rejected Rahul Gandhi's application seeking a stay on his conviction. A stay on conviction would have paved the way for Rahul Gandhi’s reinstatement as Lok Sabha MP. Rahul Gandhi was disqualified as a Member of Parliament from Lok Sabha, after he was convicted and sentenced to two years imprisonment in March this year in the Modi-surname Defamation Case. The case relates to the remarks about the Modi surname during a rally in 2019 while campaigning for the Lok Sabha polls in Karnataka.

The Surat sessions court on Thursday rejected Rahul Gandhi's appeal seeking a stay and suspension of the lower court order which convicted him in the 2019 defamation case and sentenced him to two years in jail. The sessions court heard both sides on April 13 and reserved the verdict for April 20. Rahul Gandhi cannot be reinstated as a Member of Parliament for now.
