Thane sessions court acquits man in 2018 murder case, cites lack of evidence and eyewitnesses

A sessions court in Thane acquitted a 53-year-old man accused of murdering his friend in 2018, holding that the prosecution failed to prove the case beyond reasonable doubt.

Judge RD Sawant on Tuesday acquitted Sambhaji Haribhau Dhokare. According to the prosecution, Dhokare had allegedly thrown a stone at Rajesh Chandrakant Kadam during an altercation at a rickshaw stand in Kalwa on January 30, 2018, causing a fatal head injury. Kadam died at JJ Hospital in Mumbai on February 11, 2018.

The court observed that there were no eyewitnesses in the case. It also noted that the prosecution failed to examine the medical officer who conducted the postmortem to establish that it was a homicidal death.

The judge further rejected a statement made by Kadam at the hospital as evidence, observing that it was not recorded before an executive magistrate and had no endorsement of the medical officer, and therefore, could not be treated as a dying declaration.

Dhokare, who spent over five years in jail, was given the benefit of doubt and acquitted of all charges.

Thane man arrested for allegedly killing wife after domestic quarrel in Kalyan

Thane police arrested a 39-year-old man for allegedly killing his wife after a domestic quarrel, officials said on Tuesday.

The accused, Mubin Niyamad Khan, and the victim, Ayshabano (39), residents of Hajimalang Road locality in Kalyan, were said to have frequent fights over various issues, an official from Kolsewadi Police Station said.

On June 10, the couple reportedly quarrelled again, during which the accused allegedly kicked his wife in the abdomen.

She was rushed to a nearby hospital, where doctors declared her dead.

Police initially registered an accidental death case and sent the body for postmortem. However, after receiving the autopsy report and a complaint from the victim's brother on Monday, a case under Section 103(1) (murder) of the Bharatiya Nyaya Sanhita was registered against the accused, who was subsequently arrested. Further investigation is underway.
