Thane MACT awards Rs 59.2 lakh to kin of man killed in road accident, Rs 10 lakh to his widow for injuries

The Motor Accident Claims Tribunal (MACT) in Thane has awarded a compensation of Rs 59.2 lakh to the family of a milk supplier killed in a road accident six years ago, reported news agency PTI.

The Thane MACT, presided over by Member S N Shah, also ordered the payment of Rs 10.5 lakh to the victim's wife, who suffered injuries in the accident.

The compensation, inclusive of no-fault liability, is to be jointly and severally deposited by the owner and insurer of the offending vehicle, said the Thane MACT in its order of May 21, copies of which were made available on Friday, reported PTI.

The milk supplier, Namdev Narayan Kharik, and his wife Kamalabai were travelling on a motorcycle on the Nashik-Mumbai road on March 17, 2019, when their two-wheeler collided with a speeding car, reported PTI.

Namdev, then 48, had a monthly income of Rs 50,000, advocate S M Pawar, who represented the victim's family, told the Thane MACT. Namdev's family also submitted documents to show that he owned several buffaloes, reported PTI.

Car owner Sandeep Hanuman Shendge remained ex parte (absent from the proceedings). The insurer, Cholamandalam MS General Insurance Co. Ltd., was represented by advocate P T Sonar, reported PTI.

After going through the submissions, the MACT ordered that the victim's family be paid Rs 59.2 lakh along with 8 per cent interest from the date of filing the petition until realisation. It also awarded a compensation of Rs 10.5 lakh (with 8 per cent) to Kamalabai for her injuries.

Thane MACT awards Rs 16 lakh compensation to family of man killed in 2017 accident

In another case, The Motor Accident Claims Tribunal (MACT) in Thane, Maharashtra, has awarded Rs 16 lakh in compensation to the family of a 42-year-old man who died in a motorcycle accident in 2017.

MACT member S N Shah held the insurer, Bajaj Allianz General Insurance Company Ltd., liable to pay the compensation first, even though the driver of the offending vehicle did not possess a valid licence at the time of the accident, reported news agency PTI.

The insurer has been given the right to recover the compensation amount from the vehicle's owner.

A copy of the order dated May 8 was made available on May 19.

The accident occurred on the night of June 16, 2017, when the victim, Tatu Ganpat Gaikar, was riding his motorcycle, and a four-wheeler driven rashly collided with his vehicle, reported news agency PTI.

According to PTI, Gaikar sustained severe injuries and was declared dead at a rural Hospital in Shahapur.

The insurer, Bajaj Allianz, contended that the driver lacked a valid driving licence and that the vehicle was being plied for hire, breaching policy conditions. They also argued the deceased was negligent.

MACT member Shah, in her judgment, observed that the police documents, including the FIR and chargesheet, indicated the accident occurred due to the negligence of the offending vehicle's driver.

The tribunal ordered the insurer to deposit the compensation amount with 8 per cent annual interest from the date of filing the petition within one month.

The amount will be apportioned between the widow and son, with significant portions to be kept in fixed deposits for five years.
