On Tuesday, 17 October 2023, a five-judge Supreme Court (SC) bench refused to grant legal recognition to same-sex marriages. The bench had assembled to pronounce verdicts on pleas seeking legal validation for same-sex marriage. Supreme Court Bar Association president Adish Aggarwala while talking to the media, said, "I welcome the decision of the Supreme Court where they have not allowed same-sex marriage".

The Constitution Bench is headed by Chief Justice of India D.Y. The Bar Council of India has resolved to request the Supreme Court to leave the issue of same-sex marriage to legislative process for wide spread consultation, saying that the matter is "highly sensitive" and having "social, religious and cultural connotations".
