Will Smith has scored a major legal victory after a judge dismissed a sexual harassment lawsuit filed against him by former tour violinist Brian King Joseph. The case, which had sparked significant attention earlier this year, was thrown out after the court ruled that the allegations were not legally sufficient to proceed.

A relief for Will Smith in the case

Brian King Joseph, a professional violinist who toured with Will Smith during his 2025 "Based on a True Story" tour, had accused the actor and his company, Treyball Studios Management, of sexual harassment, retaliation and wrongful termination. According to court filings, Joseph alleged that Smith engaged in grooming behaviour and claimed a disturbing incident took place during the tour in Las Vegas.

The lawsuit stated that Joseph returned to his hotel room after a rehearsal and allegedly found evidence that someone had entered the room without permission. He claimed there was a handwritten note addressed to him that read, "Brian, I'll be back… just us," signed with the name "Stone F." The complaint also mentioned several unfamiliar items allegedly left inside the room, including personal belongings and medication. Joseph argued that the incident caused emotional distress and contributed to psychological trauma.

However, the judge ultimately ruled that the complaint failed to meet the legal standard required for a sexual harassment claim. According to reports obtained by TMZ, the court stated that the lawsuit did not "adequately allege conduct that is sufficiently severe or pervasive." The judge also pointed out that the complaint lacked enough evidence proving that only Smith or his management team had access to the hotel room.

Another key issue highlighted in the ruling was the fact that Joseph had reportedly left his room key in a bag stored in a van shared with multiple crew members, meaning several individuals may have had access to the room during that period. Because of these gaps in the allegations, the court dismissed the sexual harassment claims.

Despite dismissing the lawsuit, the judge reportedly allowed Joseph the opportunity to amend his complaint and attempt to address the issues identified by the court. It remains unclear whether he plans to refile the claims or pursue further legal action.

All about the lawsuit

Will Smith's legal team had strongly denied the allegations from the beginning. Earlier this year, Smith's lawyers filed a motion seeking dismissal of the lawsuit, arguing that the accusations were baseless and lacked factual support.

The lawsuit had generated major headlines due to Smith's global celebrity status and ongoing public scrutiny following controversies in recent years. Online reactions to the dismissal have been mixed, with some social media users calling it a significant legal win for the actor, while others noted that the court's decision does not necessarily prevent amended claims from being filed later.
