Vishram's widow, Rajni Patil, has moved the court seeking to make President Pratibha Patil's brother GN Patil an accused in the case.
Inspector NS Bhuke of Jalgaon crime branch - who investigated the case initially before CBI took over - had told the court yesterday that though he questioned GN Patil after Rajni named latter as a suspect, her own statement was never recorded.
However, additional public prosecutor Aruna Pai-Kamat today said that Rajni's statement was recorded on September 21, 2005, the day of murder. The statement was handed to CBI, she added.
The Division Bench of Chief Justice Swatanter Kumar and Justice DY Chandrachud directed Bhuke to file an affidavit by April 16 explaining this contradiction. The court also asked the officer to produce relevant police station records.
According to Rajni Patil, her husband Vishram Patil was killed on the behest of GN Patil over political rivalry. But the CBI, presently investigating the case, has given a clean chit to latter and he has not been chargesheeted.
Both GN Patil and Vishram Patil were Jalgaon Congress leaders.
