Actor Rajpal Yadav received temporary relief from the Supreme Court on Tuesday, September 15. The actor was granted a final opportunity of two weeks to furnish a concrete proposal for clearing his outstanding dues amid his multiple cheque-bounce cases. The court also asked him to deposit Rs 2 crore within two weeks.
According to Bar and Bench, Chief Justice of India Surya Kant and Justices Joymalya Bagchi and V Mohana, during the recent hearing, nevertheless granted two more weeks to Rajpal Yadav to deposit Rs 5 crore. The actor was asked to deposit the amount with the court registry as a condition to avoid jail time.
Earlier, on September 8, the court had exempted the actor from surrendering, subject to him depositing the money by September 9. On Tuesday, his counsel sought an extension by two weeks to deposit the amount.
Senior Advocate PS Patwalia, appearing on behalf of Yadav, said, "He has already suffered jail time - about four and a half months. Kindly give him two weeks. Kindly call it after two weeks. I will try to comply."
According to LiveLaw, the advocate requested the court to grant him some breathing time, adding that they would return with a concrete proposal, including a draft of at least Rs 2 crore.
To this, CJI Surya Kant remarked, "He is an actor in Bollywood. We hope he is not acting here also. His past conduct does not inspire confidence. As a last opportunity, two weeks' time is granted to honour the order. Post the matter thereafter. The exemption granted from surrendering shall continue till October 5."
The court also asked Yadav to submit his passport for now.
For the unversed, Rajpal Yadav reportedly took a loan of around Rs 5 crore from a Delhi-based company to make his first film as a director, Ata Pata Laapata back in 2010. The movie did not perform well at the box office, failing to earn enough money to cover the costs. As a result, Yadav faced difficulty in paying back the loan.
Over the years, the unpaid amount continued to grow due to interest and other charges. Rajpal allegedly tendered seven cheques of Rs 1.05 crore each as part of a settlement in 2013. However, the cheques were later dishonoured.
The complainant claimed that according to a 2012 agreement, Rajpal Yadav, his wife Radha Rajpal Yadav and their company had agreed to repay around Rs 11 crore, including interest. The issue led to multiple cheque bounce complaints against the actor and his wife. He was even jailed in the matter.
